PAGAM are appealing for unity and strength from the residents of Pagham, Aldwick and Bersted. I apologise for the length of the text but bear with me ......

 

Obviously and quite rightly we have all been pre-occupied with COVID-19 and the huge impact it is having on our lives and this website clearly appreciates the commitment and risks that those in the NHS and other critical services are facing up too.

 

Whilst all this has been going on, Taylor Wimpey have quietly and cynically submitted a section containing conditions of the Reserved Matters application for Sefter Rd., or as it is better known, Lake Sefter under P/24/20/RES which Arun have stated will be decided BY LATE JUNE 2020, presumably by a 'virtual DCC planning meeting' as advised by the Government, something that fills us with dread when you consider the Hollywood performances that have taken place in the past in the Council Chambers, the thought of this being remotely conducted from 20 odd different locations can only be viewed with much consternation, ADC struggled to even get the sound or web casting working at various meetings let alone this scenario. Residents seem to be of the opinion that Taylor Wimpey have taken advantage of the confusion going on to force this application through, no doubt encouraged wholeheartedly by the ADC Planning Dept. whose only brief is to increase their housing supply figures which are well under the 5 yr. supply required by the Government.

 

BUT IS IT TO LATE TO OBJECT AND THE ANSWER IS NO .... although the website appears to have been dormant there has been much work and research going on in the background.  PAGAM  suggest that the following reasons could carry weight in an objection but it would have to be what you believe is relevant, we are only here to provide information dissemination and have no intention of steering you along any given path, that is your decision.

 

a)  ADC's own Local Plan states that major developments must provide 10% of the total predicted energy generation on site using solar panels, air or other alternative  heat pumps etc. UNLESS the developers state that it is unviable (i.e. eats into their profits ..) The Committee for Climate Change that advises the Government have stated that by 2025 at the latest, no new homes should connect to the gas grid but instead use alternative heating methods. They stated it would cost approx. £4800 to add heat pumps to  a new build but £26300 retrofitting (the owners footing the bill) This is unacceptable, the builders are via ADC passing the buck to the new home owners. Remember, when was the last time you saw new builds around here with solar panels or water heating panels fitted !. UPDATE .. TAYLOR WIMPEY ARE RECOMMENDING VIA ONE OF THE CONDITIONS WITHIN THIS APPLICATION THAT SOLAR PANELS WILL BE FITTED.

 

b)  Taylor Wimpey are trying to mitigate the flooding we are all so conscious of by constructing very large cascaded balancing ponds at the bottom of the development behind Gills Flowers/The Coop in Rose Green Rd. where it is at its most severe. This ultimately would be pumped into the Rife which will have to accommodate the Chichester Relief Channel, the new Spinnaker View site of 40 properties behind the Bear, the proposed 90 homes in Summer Lane, the proposed 300 + homes at Hook Lane, then 450 + homes at Pagham Rd., the 6 homes behind Sefter School and the 2700 + homes proposed at Chalcraft Lane, all destined to dump their gray water (non sewage) but NITRATE loaded with no chance of this being filtered out. Southern Waters latest report states that the Pagham Rife will remain at a chemical FAIL status for at least the next 10 years.

 

c)   The condition of the lower Pagham Rd. is contentious but think about this, there is much road building taking place to the East of us (no surprise), think the new A259 dualling between Angmering too just past Haskins Garden Centre, the new Lyminster bypass going North from Littlehampton to the A27, the proposed re-alignment of the A29 Bognor to the A27, and the proposed improvements between Middleton on the A259 to the Tesco roundabout at Littlehampton including work on all junctions. Did you I notice I forgot to mention/omitted the Pagham Rd. between Pagham village and the A27 at Whyke, not ONE PENNY to improve or widen the road, just some MINOR improvements to junctions. We are being taken for fools, you decide.

A MEETING WITH A DIFFERENCE ON 18TH. SEPTEMBER 2019 6PM. AT ADC OFFICES LITTLEHAMPTON THAT RESIDENTS SHOULD ATTEND ...

 

The above meeting could have the potential to slow down the process of housing development within or surrounding our village due to a motion being put before all Councillors at a Full Arun District Council meeting on this date. The Independent Group through its instigator Tony Dixon have asked that the following statement be debated in depth and voted upon, and I quote directly the following ..

 

Motion 1 – from the Independent Group relating to climate change and the implications for large scale development on the coastal plain

 

Climate change is real. It doesn’t matter whether we believe it is man-made or the end of the last ice age – climate change is happening – and quickly.

 

We are compelled, against our will, by government, to build 20,000 new homes on a coastal plain. As councillors, we are required to consider and determine planning applications for 20,000 new homes on this part of the coastal plain in the coming years.

 

Yet, here in Arun District the environmental risks are already substantial and increasing. The district is uniquely unsuitable for large scale development because it is particularly vulnerable to the risks arising from climate change, in addition to every type of flooding that already occurs in this country.

 

In Palaeolithic times the land we now live on was under the sea. The Slindon, Norton and Aldingbourne raised beaches, roughly following the line of the A27, remind us where the beach once was. If the coastal plain was under the sea once, it can be again.

 

Sea levels have been rising since the end of the last ice age (approx. 11,700 years ago) and continue to do so. As sea levels rise, and extreme weather events increase, as anticipated by scientists around the world, flood risk will increase significantly, yet we have no coherent and deliverable plan or funding for effectively guaranteeing the prevention of this risk to the residents of the district.

 

Large scale development in an area at risk of coastal and tidal flooding, flash flooding, surface water flooding, groundwater flooding from chalk aquifers and fluvial flooding is irresponsible.

 

Because we live on a coastal plain the land is flat and the water table is very high. Drainage of surface and ground water to the sea is slow, even more so at times of major weather events, via a small network of rifes that are tide locked twice a day. We also have the South Downs to the north shedding water southwards towards the coastal plain and sea.

 

Against this background, this Council believes that the Local Plan does not adequately protect new and existing communities from increasing flood risk. Therefore, we have no confidence in the Local Plan.

 

The Council calls on the Government to introduce a moratorium on large scale development in the Arun District whilst climate change and its potential impact on coastal plain development is properly assessed at governmental level.

 

The Council instructs the Chief Executive to write to the appropriate Government Minister to notify him/her of this motion and to request a meeting with the Minster in order to discuss it.

 

We also call on local MPs to engage with the concerns raised in this motion and to assist the Council in taking these concerns to Government.

 

It is our opinion that as many residents as possible should try and attend this potentially ground breaking moment in Pagham's historical timeline because in the past previous politically aligned groups of Councillors in ADC would have never considered the gravity of such situations and merely followed a more submissive political stance. 

 

Let us show the newly elected Councillors that we respect the work that they have put into this motion and that it should succeed, putting common sense before profit.

A  RESPONSE WITH RESPECT TO THE LETTERS THAT RESIDENTS HAVE BEEN RECEIVING FROM ADC OVER THE PLANNING INQUIRY FOR HOOK LANE P/6/17/OUT SCHEDULED FOR THE 22ND. OCTOBER 2019.

 

Yes, in theory the Inquiry may still go ahead at Littlehampton due to the fact that although Hook Lane was given Outline planning permission at the meeting on the 7th. August 2019, the actual date was extended to the 2nd. September as ADC had various internal problems, this then meant they also had to give Pagham Parish Council 42 days from that date to consider whether they wanted to mount a Judicial Review against that decision. As the Apellant (is this case Hallam) were the instigators to the request for an appeal, it seems they would obviously hold back just in case. It thus has taken on the true definition of a farce as in theory it would be held at ADC offices but ADC have already pulled out of fighting Hallam, and due to that Pagham Parish Council had to withdraw from Rule 6 status (i.e. to directly fight Hallam at an Inquiry) as Hallam could potentially bankrupt the Parish if Hallam applied for costs. So ..... everyone apart from Hallam including the residents of Pagham et al would be arguing their case as third parties to the Planning Inspector.

UPDATE ON PLANNING DEVELOPMENT CONTROL COMMITTEE (DCC) MEETING

 

ON 7TH. AUGUST 2019 AT ARUN DISTRICT COUNCIL 2.30PM

 

 

Yet again I've been forced to hold back and reflect on what happened on August 7th. 2019 due to the sheer weight of additional information that has come in my direction from many sources.

As you are all no doubt aware, the second application for developing the land at Hook Lane P/30/19/OUT was approved 7-6 with some catastrophic twists of fate causing its downfall.  We are awaiting official confirmation from the Planning Inspectorate in Bristol that Hallam the developer has officially withdrawn his appeal against the first application P/6/17/OUT which scuppers our opportunity to have fought this in a more professional manner, in effect in a simple Court of Law i.e. a Planning Inquiry.  Both David Huntley and June Hamilton, Independent District Councillors for Pagham on the Development Control Committee were excluded from being part of that DCC meeting and were thus denied the right to vote due to 'predetermination' which I will explain later.  The Vice Chair Isabel Thurston (Green Party) was absent to holidays and was substituted by another Green member Faye Catterson, so no problem there. Billy Blanchard-Cooper (Lib/Dem) partner was rushed to hospital therefore not in attendance but the Lib/Dems could not find a reserve substitute quick enough so 1 down, then Amanda Worne (Lib/Dem) gave her apologies and yet again no Lib/Dem reserve substitute was available ... so now 2 down ! To add devious intrigue to the proceedings 2 Conservative members gave apologies so Terence Chapman and Mike Claydon (both Conservative) were substituted who we are told are qualified to be on this Committee, EXCEPT they are not on the official Reserve List as published on the ADC website which we believe is constitutionally wrong and the Monitoring Office Liz Fulcher at ADC has failed to give a satisfactory response to such suggestion when questioned.  We are now left with the reality that many residents are questioning why the Lib/Dems were wrong footed on this, as if they had been up to strength it is highly likely it may have gone our way.  What do you think ?

 

I have given you the exact facts as it happened to avoid confusion or misleading information being spread around, and I apologise for it being definitely long winded

PREDETERMINATION

 

In very simplistic terms as you would not have wanted to see the legalistic response of Liz Fulcher at ADC, it is where a Councillor (in this case David and June) has argued/rallied/commented publicly against a particular area of development of which Pagham has many.  This may have been at the council elections in 2019 or similar but they like every candidate would have had the right to argue strongly against excessive housing in Pagham as they were campaigning for the Pagham Ward, it could have been Yapton, Angmering, Bersted in fact anywhere in the District where they are trying to offload large quantities of housing onto us.  However both Richard Bower (Conservative) who used to be the DCC Chairman whom many will no doubt remember and John Charles (Conservative) who was the Inner Cabinet Member for Planning both consistently and strenuously argued in previous DCC meetings concerning Hook Lane that it had to go through as it was in the Local Plan.  They reiterated as such the same arguments at the meeting on the 7th. August and it is our belief they were both heavily predetermined based on past performances which could potentially be proved where meetings were Webcast (videoed) such matter being in the Public Domain on ADC's website.  However THEY were allowed to remain on the DCC and vote unlike David and June.

 

It would benefit our village if someone, maybe who is retired might feel strongly enough to consider researching in association with us the legal structure of Arun's Constitution such that we could prove this meeting was or should be declared null and void pending an Inquiry into the way the meeting was conducted both pre that meeting or during that meeting.

 

PAGAM have a Fighting Fund whereby we would be prepared to fund such a person of the right disposition who would have the interests of our historic village within their heart.  We do not expect such an individual to undertake such a task lightly as documents/statements and evidence has to be assessed from all quarters such that a potential legal challenge might be mounted.  ADC may think they are infallible but there is David and there is Goliath, need we say more.  If such a person would like to discuss this further please email in confidence to the Committee of PAGAM on info@pagam.uk

THE RESULTS ARE IN FOR THE ARUN DISTRICT COUNCIL

LOCAL ELECTIONS 2ND. MAY  2019

 

Those of us waking up in Pagham and the surrouding areas this morning the 4th. May 2019 will no doubt be aware of the results that were finalised yesterday afternoon but for those who do not know here they are (with the previous figures 2015 to 2019 in brackets) ..... plus we are proud to announce David Huntley and June Hamilton are now our elected Independent District Councillors for Pagham, congratulations to them and their agent Giles Binyon for bringing this about with such over whelming results, I'm sure they are forever thankful to Pagham residents for their support.

The Council is made up of 54 elected members across 23 wards in the Arun District and are elected every 4 years.

 

The new Council will comprise >>>> 

 

Conservative     21 seats (42)     Lib/Dem     22 seats (7)     Independent     8 (3)     

Labour     1 (1)     Green     2 (0)     UKIP     0 (1)

 

However, although the Lib/Dem have the greatest number of seats, the Council is defined as NOC (no overall control), this is because in practice if all the OTHER parties seats were added together (i.e. they were to all vote against the Lib/Dems) they would outnumber them .... 21+8+1+2 = 32.  But crucially, due to proportionate representation the Lib/Dems/Independents/Labour/Greens will have a stronger voice in the Committees that will be newly formed when the dust has settled. A new leader of the Council will also have to be elected, as well as Chairman and Vice Chaiman as well as a Cabinet. Extensive training will also take place, particularly for those elected into Committees, so it may be a while before any decisions are taken at Planning level as an example due to such training.

BREAKING NEWS FOR PAGHAM RESIDENTS 20TH. MARCH 2019

 

AN ACHIEVEMENT THAT RAY WOULD SURELY BEEN PROUD OF

 

PAGAM have just been informed by Pagham Parish Council that the Judicial Review Oral Hearing covering the Pagham Rd. development had a positive outcome yesterday the 19th. March 2019. The second judge found that leave should be given for the case to proceed to the High Court on 2 out of the 3 arguments presented by our barrister. Everyone in Pagham should now realise that anything is possible if you try hard enough. Pagham Parish Council are now waiting for formal written confirmation from the high court, we will endeavour to pass on more information a later stage A momentous decision, thank you Pagham Parish Council, Paul Collins their consultant and above all everyone else who has supported this fight.

ADC are not invincible, just arrogant, Karl Roberts had said "£105,000 is the absolute worse case scenario should we proceed until the end of the process and lose. But potentially this process could end in two weeks if the judge agrees with the first judge’s decision that there isn't grounds to challenge the decision. If that happens then council has incurred no costs and will be able to recover everything they've spent to date." 
Remember that’s £105,000 of tax payers money, our money!!

PS. And not to be overshadowed, Hook Lane is going to appeal at a Planning Inquiry presided over by a Government Planning Inspector  as a repeat of 1999 !! (Details to follow but remember it was won then ..)

WHAT HAPPENED AT THE ADC PLANNING MEETING ON THE

23RD. JANUARY 2019


For those residents unable to attend the ADC Meeting at Littlehampton on the 23rd. February 2019, we can confirm that Hook Lane P/6/17/OUT (300 homes) was conclusively REFUSED. The reason for the refusal was as follows ... " The increased vehicle movements generated by the application will exacerbate capacity issues on the Local Highways Network and the mitigation measures proposed are insufficient to overcome the safety concerns resulting from the increased vehicle movements" ...


We take this oppoertunity of thanking the Councillors who fought so hard to achieve this against strong words being uttered over the dire consequences of rejecting this application. ADC even had a Barrister there yet again to try and 'frighten' those who dared object but community spirit shone through.


 Church Barton was approved in the most perverse fashion as the vote was an even split, so the Chairman Ricky Bower had the casting vote and as to be expected, voted it through. In effect it is an approval for up to 65 Homes with no access, and therefore nowhere to go.

THE FUTURE OF PAGHAM PART 1   24TH. OCTOBER 2018

 

The meeting of the Planning Development Control Committee (DCC) that took place at Arun District Council on the above date should be of grave concern to us all in Pagham, regardless of which of the 3 sites are closest to us

 

KEY POINTS FROM THAT MEETING ...

 

Pagham Rd. (400) Hook Lane (300) Sefter (280)  remembering this is for Outline Planning permission i.e. Matters of Access ... how to get in and out of the proposed sites.

Pagham Rd. (Hanbury) passed 7-5 votes with 2 abstentions

Hook Lane (Hallam) refused 7-6 WITH 1 abstention

Sefter Rd. (Taylor Wimpey)  NOT debated  MEETING SUSPENDED

 

DISCUSSION POINTS TO FOLLOW UP ON ...

 

Meeting was UNDEMOCRATIC on the grounds that many residents of Pagham unable to attend due to date convened, in half term; older residents on grand parenting duties; many residents at place of employment and elderly residents unable to travel to Littlehampton so disadvantaged. Meeting specifically about Pagham so should have been held locally.

Meeting was a shambles, sound unavailable to rear 2 rooms that had seating arranged, everyone shunted up into council chamber. Video recording unavailable to allow retrospective viewing for those unable to attend. (and this happened at the Local Plan meeting months previous)

Meeting was chaired in a process that at times could be construed as undemocratic, Councillors being reminded on several occasions that as they had voted through the Arun Local Plan with the 2 Strategic Sites Pagham South and Pagham North, it would be inappropriate/incorrect to refuse the applications. They were also reminded of the costs that could be incurred if the developers appealed, an appeal that ADC would lose at great expense.

As the Committee are on the DCC they hardly need reminding of the seriousness  of their  decision making responsibilities so comments like this from the Chairman and the Group Head of Planning could be construed as thinly veiled threats that would add to the pressure being applied upon them.

PAGHAM PARISH COUNCIL APPOINTS CONSULTANT 

 

An objection letter has just been placed on the Arun Planning Portal section of their website that confirms that Pagham Parish Council has appointed and is in association with Mr. Paul Collins BA (Hons) Dip TP Town and Country Planner to advise of the procedures that should be adopted against the 4 developments proposed for Pagham. The following is the part of the letter to ADC that should give strength to residents hoping for a more positive outcome ....

Outline planning applications P/140/16 OUT – Land south of Summer Lane & West of Pagham  Road, Pagham, P/134/16 OUT – Land north of Sefter Road & 80 Rose Green Road, Pagham, P/6/17 OUT – Land north of Hook Lane, Pagham, P/25/17 OUT ‐ Church Barton House, Horns Lane, Pagham

 

I am instructed by Pagham Parish Council (PPC) in these matters.

 

Pagham Parish Council has been advised by PCU that Arun District Council DC intends to determine these applications at a Special Development Control Committee (SDC) on 24 October 2018 and that should the Council be minded to approve any of the applications the Council has agreed not to issue a decision notice until the Secretary of State has decided whether or not they should be called – in.

 

For those of you unfamiliar with the name, Paul Collins back in 2000 was the Head of ADC Planning Dept. when a certain development at Hook Lane emerged. In simple terms, through a concerted effort by residents and ADC it was refused and the case went to the High Court for Appeal. That appeal was thrown out, the Planning Inspector agreeing with the case presented by the Council. REMEMBER, the same arguments prevail 18 years down the line and Hook Lane should be thrown out again !
